Minutes of Planning Commission June 24, 2008

Meeting called to order at 7:30 p.m. by Chairperson, Dale Witt.

 

Members present:  Dale Witt, Steve McGee, Jimmy Colburn, David McCrate, and Cheryl Benham.

 

Bob Utter Absent - Excused

Ron Weber Absent – Un-Excused.

 

Agenda:          McCrate motioned to accept June 24, 2008 agenda, seconded by Colburn.  Motion carried.

 

Minutes:         McCrate motioned to accept June 10, 2008 meeting minutes, seconded by McGee.  Motion carried. 

 

Public Comments: There were no public comments.

 

Public Hearings:         Site Plan for Penrod Pond, 4864 Holloway, RAO-122-4840-00

Motion by Witt to open the public hearing without objection.  No outside communications have been received, and no public attendants were present.  The applicant, Jana Penrod was present.

 

Review of the site plan checklist.

 

Number 3 is accepted as “yes” though the address of the property is not shown, the RAO number is wrong, and the name of the engineer is not listed. (Sections 9.90.4.A.2 and 9.90.4.A.3)

 

Number 5 is accepted as “no” the engineering firm did not place adjacent property owners on the site plan per the checklist. (Section 9.90.4.A.4)

 

Number 7 is accepted as “no” it is not required for this site plan.

 

Number 9 is accepted as “no” it is not required for this site plan; it fronts on Holloway Road, and has 33 ft. right-of-way.

 

Number 12 is accepted as “no” there are none on site, this is “n/a”.

 

Number 13 is accepted as “no” there are none in the vicinity, this is “n/a”.

 

Number 14 is accepted as “no” the ordinance states in section 9.101.1.2.e “the property owner shall be required to provide a test hole to determine the proper depth of the pond.  The property owner must contact the Township within 48 hours of the hole being dug to test the depth.

 

Number 15 is accepted as “no” it is not required for this site plan.

 

Number 16 is accepted as “no” it is not required for this site plan.

 

Number 18 is accepted as “no” this site plan is an existing site plan, the existing buildings setbacks are shown.

 

In a letter from Consumers Energy dated August 29, 2007 it is their recommendation to maintain a 5 ft. minimum distance from the buried power line to the pond.  Consumers Energy does not require an easement for underground services for this project.

 

Ms. Penrod stated that it is her intention to maintain the 5 ft. distance from the power line.  She stated that the line is already laying uncased in wet ground, if the line shorts it will follow the path of least resistance which is the ground, and it will short out to the transformer box if that does happen. The Planning Commission took no position on the applicant’s comment.

 

Question was asked of the petitioner what is she going to do without a drain line for the sump pump?  The applicant stated that she was not aware of this notation on the drawing, and would leave the sump drain line to the pond.

 

Public Hearing Closed

 

Motion by Colburn to approve the site plan for Jana Penrod, to construct a pond at 4864 Holloway, RAO-122-4840-00, to be constructed per all pond ordinance requirements of Raisin Charter Township.  Support Benham.

Communications:

The Township has retained OHM to overview, on an as need basis, the site plan review services, site review and construction observation, soil erosion control services; private road review and construction observation.

The 2nd Tuesday will be the regular scheduled meeting at 7:30 p.m.  If necessary, the 4th Tuesday will be an optional meeting.

 

Motion by Benham to accept the listed calendar dates for 2009 for the Raisin Township Planning Commission, support Witt.  Motion Carried.
